Important Information On The K1 Fiance Visa

A k1 fiance visa is a very helpful document for American women who are planning to have foreign spouses. This document gives their spouses temporary citizenship to help them formalise their marriage. Once the marriage has been completed successfully, they can start the process of making the application for permanent citizenship. If the marriage fails to take place, on the other hand, the document is nullified and the holder is deported.

The application typically starts with the filling of the corresponding form at the United States Immigration Department. This is evaluated and sent to the American Embassy office that is closest to the applicant. The embassy then requests the applicant to undergo a comprehensive medical examination and to go for an interview. The main role of the interview is to establish whether the said relationship indeed exists and whether or not is legal.

The visa is only issued when the embassy is convinced of a relationship that meets all requirements. This document is annotated with the name of the petitioner, printed on self adhesive label and placed on the passport of the foreigner. It is valid for a single entry in to the United States within six months of being given. The average time between filing a petition and receiving the visa is eight months.

Certain conditions must be met for one to qualify his application for the document. The two spouses must be of legal age and not already married to each other or to a third party. Same sex petition filing has now been officially made legal although it was prohibited in previous years. Persons not eligible for the visa include those who have engaged in crime, drug addicts and former deportees.

Another important prerequisite is that the couple must have met physically within the previous two years preceding the application. The only exception is where religion and culture forbid this meeting. The immigrant has to demonstrate financial independence so that they do not become a burden to the public when they move to the United States. ID cards, a divorce decree (if it exists) and a birth certificate may be asked for at the office.

The visas have been related to numerous frauds in the recent past with many illegal immigrants using this option to enter the United States. This has resulted into tighter rules as regards permanent citizenship. This citizenship is only given after at least two years of staying in the marriage. Even after the issuance of this citizenship, dissolution of the marriage can lead to nullification of citizenship.

The spouses are closely monitored within the two year period to prove that their relationship is valid and that there are no issues that can cause suspicion of a fraud. Logically, the couple should have activities or interests in common. These include for instance, language, religion, property and joint vacations among others. Of crucial importance is the need for a sense of reality and honesty in the marriage.

The good news is that most of the k1 fiance visas that are applied for are awarded. If the details are filled in accurately and there is no criminal record there is a chance of almost 100% that the application will be approved. Revocation will be caused by either fraud or failure to meet the requirements.
