Common Questions Regarding The False Claims Act

By Bob Oliver

The False Claims Act is, without question, one of the most important sets of rules for whistleblowers to abide by. I am sure that while those in this field can attest to such a sentiment, others may be left scratching their hands. As much as they understand the FCA, by name, its specific may go over their heads more often than not. Make sure that you go about bringing up these inquiries, as they may help you understand what the FCA is all about.

"What is the False Claims Act all about?" For those who do not know, the FCA allows people to showcase evidence related to fraud without negative repercussions. Many of the repercussions in question tie back to employment, as many people fear for their jobs when they do this. It's unfortunate, to say the least, but this level of fear is understandable. However, to put it simply, the FCA was designed - and enacted back in 1863, mind you - to protect these men and women.

"What are seen as violations of the False Claims Act?" What aren't you allowed to do, as it relates to the FCA, you may wonder? It's fortunate that most of these violations are ones which most people wouldn't think of doing in normal scenarios. To illustrate this point more effectively, it's against the rules of the FCA to attempt to get a false claim paid by the government. Ethical problems arise from these situations, which is what the law in question is designed to prevent.

"Where can I learn more about the False Claims Act?" Even though you may have obtained ample information from a singular source, you may be curious about where you can learn more. The FCA is well-known by various entities, meaning that it's in your best interest to contact names like Whistleblowers Against Fraud. Not only do they know about the law in question, but they have worked with several cases over the past number of years. Suffice it to say, they can tell you as much as you'd like to know about the FCA.

It goes without saying that the FCA holds a tremendous level of importance. There are several guidelines to take into account, some of them understandably more familiar than others. Even though whistleblowers across the board understand what the FCA entails, others may be less than familiar with this concept. With that said, if you take it upon yourself to learn, you'll start to see just how much this set of guidelines truly matters.
