Without A Bail Bondsman La Habra Accused Can Be Kept Incarcerated

By Matthew Stone

Most people are not even fully aware of all the many laws and regulations that rule their daily lives. The complexity of modern society makes in necessary to introduce numerous laws to make sure that law and order prevail. Transgressors are arrested and charged and tried by a court of law. Sadly, the courts are swamped with a backlog of cases and new cases are routinely delayed for months. But with help from a bail bondsman La Habra accused can go free.

Thousands of arrests are made each year and many of those arrested are normally law abiding citizens that made stupid mistakes. Being arrested is a stressful experience and the prospect of being found guilty of committing a crime is a daunting one indeed. That is why anyone accused of committing a crime should immediately appoint an experienced criminal defense attorney to deal with the matter.

Unless there are very good reasons not to do so, the majority of arrested individuals will be released until the courts are ready to hear the case. There are conditions attached, however. The accused is not allowed to contact witnesses, to travel outside the jurisdiction of the court or to act in any way that may pose a danger to himself or others. Other conditions may be added as well.

In order to make sure that the accused will adhere to the conditions of his release, he is required to pay a deposit before he is allowed to go free. This amount, which differs from one case to the next, is refunded once the case is finalized. Many accused cannot raise the money needed quickly, but they can approach bondsmen for fast loans. Bondsmen specialize in providing quick loans to accused individuals.

Bondsmen are only too aware of the fact that their clients are desperate to be released. By offering a fast and efficient service, they often finalize an application and pay the surety within an hour or so. For this service they charge between ten and fifteen percent of the total loan amount. In some cases this can be a very hefty fee. The client also has to sign an agreement.

The conditions of the agreement signed by clients are extremely strict and if any of these conditions are broken, the assets pledged by the client may be seized. Most accused do not study the terms of the agreements they sign with bondsmen because they are so stressed at the time. The best solution is to ask the attorney to negotiate a deal with the bondsmen and to explain the terms.

Breaching the conditions of being released will almost certainly turn out to be a massive mistake with serious consequences. The offender will be arrested once again and he will be charged with additional criminal offences. He will lose the money paid as surety and the court may not be so lenient to allow a second release. If they do, the accused will have to take out a second loan from the bondsmen.

The system is not perfect but there are not really any alternatives. People cannot be detained for months on end without being tried. Until a court finds someone guilty, he must be treated as innocent. This is a constitutional right.
