Without Process Servers West Palm Beach Legal Matters Cannot Be Concluded

By Margaret Evans

Every single day thousands upon thousands of legal cases are initiated. At any given time, the courts have long lists of cases waiting to be heard and law enforcement agencies have also got numerous cases being prepared for the court. Legal forms too, bring numerous cases to the courts every year. It goes without saying that all these multitude of cases are accompanied by mountains of paper work. Without the help of professional process servers West Palm Beach courts and legal firms simply would not be able to operate.

There are strict laws that stipulate that all parties involved in a legal proceeding need to be aware of the fact or they must be made aware of the case. To this end, all relevant documentation must be made available to every party involved. This documentation must, in most cases, be handed personally to the individual concerned. In the past, sheriffs performed this duty but it has become an enormous burden, hindering the execution of their other duties.

The serving of all this many legal documents is a monumental task. These day the work is done by professional serving officials. Most of them work as independent professionals, serving documents on behalf of the courts, legal forms, large companies, government agencies and even the police. They are paid a fee for each case concluded. They also need to provide solid proof that delivery has been made in person.

In order to enter this profession, one needs to be licensed. In many states, formal training is required but in some states the only criteria are that the applicant must not have a criminal record and his credit history needs to be clear. Ex law enforcement officers often enter this career and most private investigating forms also have a section dealing with the serving of legal documents.

Contrary to popular belief, serving legal papers is not an easy, straight forward job. In many cases the intended recipient must first be located. People move around, sometimes far away and locating them can take time. There are also many recipients that know very well that a case cannot be proceeded unless they have been served. They therefore deliberately hide from the server.

If finding some intended recipients is not difficult enough, serving professionals also have to deal with hostile people and situations. Some recipients are abusive and may even become violent. There has been many cases of assault too. Some professionals are even licensed to carry side arms. The police will only help if they are convinced that the serving official is in danger. By the time they agree, the recipient has often disappeared once more.

On top of all the other complications serving officials must adhere to the laws governing trespassing on private property. They are not allowed to serve papers by breaking these laws. This makes things even more difficult and it can be extremely cumbersome to meet the recipient face to face in order to complete the serving.

There can be absolutely no doubt that serving professionals play a vital role in helping to streamline the entire justice system. No case can proceed until all the legal requirements, including the delivery of relevant documents, are met in full. It is certainly a challenging career but it can be lucrative too.
